Texas Furnace, L.L.C. extends a limited warranty to the original purchaser of our products. This remedy shall be the exclusive and sole remedy of Buyer, for any breach of warranty. This warranty provides that a replacement part will be provided for any part that fails due to defects in material or workmanship for a period of 66 months from the date of manufacture. Our warranty is limited to the exchange of a defective part, FOB Houston, TX. It does not provide for replacing a furnace, or for reimbursement of any labor charge or incidental charges incurred in the repair. Any part supplied under the terms of this warranty shall assume only the unused portion of the original warranty on the part replaced. The consumer is responsible for the shipping costs of the part from our factory, and the return freight back to our factory, if return of the part is required. All warranty claims must be submitted to us in writing, no more than 60 days after failure of the part. No warranty claims will be processed after the expiration of the warranty period, plus 60 days.
20-YEAR HEAT EXCHANGER WARRANTY
Gas fired furnace heat exchangers shall be warranted to the original owner for a period of 240 months against defects in material and workmanship from the date of manufacture. Warranties contained in this document are in lieu of all other warranties, either expressed or implied. This warranty supersedes any prior, contrary, or additional representations, whether oral or written. Texas Furnace, LLC, hereby disclaims and excludes all other warranties, whether expressed, implied, or statutory, including any warranty of merchantability, any warranty of fitness for a particular purpose, and any implied warranties otherwise arising from course of dealing or usage of trade.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
No one or entity is authorized to make any warranty in behalf of Texas Furnace, L.L.C.
In no event, shall Texas Furnace, LLC be liable for any incidental, special, indirect, or consequential damages, whether resulting from non delivery, or for the use, misuse, or inability to use the product, or from defects in the product or from Texas Furnace´s own negligence or other tort.
Some states do not allow the exclusion of incidental or consequential damages, so the above limitation may not apply to you.
This warranty gives you specific legal rights, and you may have other rights, which vary, from state to state. This limited warranty is null and void if the furnace is subject to any of the following:
1. The furnace has been installed in a manner that is not consistent with the manufacturer´s installation instructions.
2. The installation does not meet applicable building codes.
3. The furnace was not installed and/or repaired by a qualified mechanical contractor.
4. If a governmental authority required inspection of the contractor´s finished installation, and this inspection did not occur.
5. The furnace has in any way been modified.
6. If not operated or regularly maintained in accordance with the manufacturer´s operation and maintenance instructions.
7. The furnace has in any way been damaged or compromised through the installation and operation of any accessory product.
8. The furnace was installed and operated in an area of corrosive agents.
9. The defect or damage was caused by unusual operating conditions, energy supply fluctuations, abuse, neglect, accident, fire, riot, flood, or other acts of nature.
10. The manufacturer´s name and rating place has been defaced, removed, or altered.
11. The furnace is installed outside of the United States or Canada.
To obtain warranty service and/or parts replacement you must notify your selling dealer or contractor of any defect within the applicable warranty period. All Warranties implied by state law, including any implied warranty of merchantability and fitness for a particular purpose, are expressly limited to the duration of the limited warranty set forth above. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. With the exception of any warranty implied by state law as hereby limited, the foregoing express warranty is exclusive and in lieu of all other warranties, guarantee, agreement and similar obligations of manufacturer or seller with respect to the repair of replacement of any product or part.
In no Event Shall Texas Furnace L.L.C., be Liable for Consequential or Incidental Damages. Some states do not allow the exclusion of incidental or consequential damages, so the above limitation may not apply to you. No person, agent, distributor, dealer or company is authorized to change, modify or extend terms of this warranty in any manner whatsoever. The time within which an action must be commenced to enforce any obligation of Texas Furnace L.L.C., arising under this warranty or under any stature, or law of the United States or any states thereof, is hereby limited to one year from the date you discover or should have discovered, the defect. This limitation does not apply to implied warranties arising under state law so the above provision may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
Any controversy or claim arising our of or relating to this warranty, or the breach thereof, shall be settled through binding arbitration administrated by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. This is the exclusive and sole remedy of Buyer, for any breach of warranty. Pursuit of any legal remedy must occur in Harris County, Texas.
